Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the TendersAI platform at tendersai.co.za and related services (the “Service”), operated by Aveza Venture Agency (Pty) Ltd, registration number 2015/145836/07(“TendersAI”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TendersAI aggregates publicly advertised South African government tender opportunities and provides AI-assisted analysis, matching, and intelligence to help businesses identify and prepare bids. The Service is an informational and decision-support tool only.

2. No guarantee of outcomes

TendersAI does not guarantee that you will be awarded any tender, that any opportunity is current, accurate, or complete, or that our analysis is free of error. Tender information is sourced from third-party portals (including the eTenders portal) and may change, be delayed, or be withdrawn without notice. You are solely responsible for verifying all tender details, deadlines, and requirements directly with the issuing organ of state before relying on them or submitting a bid.

3. Accounts and eligibility

• You must be at least 18 years old and authorised to act for your business.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• You must provide accurate information and keep it up to date.

4. Subscriptions, credits and payment

The Service is offered on monthly subscription plans, each including a number of Deep Analysis credits. Payments are processed by Payfast, a licensed South African payment provider. By subscribing, you authorise recurring monthly billing until you cancel. Prices are in South African Rand and include VAT where applicable. We may change pricing on reasonable notice; changes apply from your next billing cycle.

Cancellation and refunds are governed by our Cancellation Policy and Refund Policy, which form part of these Terms.

5. Acceptable use

You agree not to:

• Resell, redistribute, or scrape the Service or its data without our written permission;
• Reverse-engineer, interfere with, or attempt to gain unauthorised access to the Service;
• Use the Service for any unlawful purpose or in breach of any tender or procurement rules;
• Share a single account across multiple unrelated businesses.

6. Intellectual property

The Service, including its software, design, and AI-generated analysis, is owned by or licensed to TendersAI. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own business purposes during your subscription. The underlying public tender data remains the property of its sources.

7. Limitation of liability

To the maximum extent permitted by law, TendersAI is not liable for any indirect, incidental, or consequential loss, including lost profits, lost tenders, or lost business opportunities, arising from your use of or reliance on the Service. Nothing in these Terms limits any rights you have under the Consumer Protection Act 68 of 2008 or other applicable law that cannot lawfully be excluded.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or circumstances beyond our control.

9. Privacy

We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy. We collect only what is needed to operate the Service and do not sell your personal information.

10. Suspension and termination

We may suspend or terminate your access if you breach these Terms. You may stop using the Service and cancel your subscription at any time as set out in our Cancellation Policy.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
